Terms of service

About these terms
These terms apply when you buy artwork or event tickets from MCP Art Gallery, Dallas, Texas ("we", "us"), through our online store at shopify.mcpgallery.art, our website mcpgallery.art, or in person. By placing an order or attending one of our events, you agree to them.
Our store runs on Shopify, which processes payments on our behalf.
Orders, prices and payment
- Prices are in US dollars. Sales tax and shipping are shown at checkout before you pay.
- Your order is confirmed when you receive our order confirmation email. Until then, we may decline an order, for example if a one-of-a-kind piece has just sold or a price was listed in error; if we do, we refund any payment in full.
- Payment is taken when you order, through Shopify's checkout. We never see or store your full card number.
- Most of our artwork is one of a kind. If two people order the same piece at the same moment, the first completed order gets it and the other is refunded in full.
Artwork
- Originals. Each piece is handmade, so texture, brush marks and small variations are part of the work, not defects. Photos are taken in natural light, but colors can look different on your screen.
- Commissions. For a commissioned piece we agree the size, subject, price and timeline with you in writing before we start. A commission is made for you alone and can't be returned (see Refunds below).
- Copyright. Buying a piece gives you ownership of that physical artwork. The artist keeps the copyright, which means you may display, sell or give away the piece, but not reproduce it (prints, merchandise, digital copies) without our written permission. We may photograph and show the work in our portfolio and on social media.
- Care. Each piece is sold as-is with care notes where relevant; keep it out of direct sunlight and damp to protect it.
Events and workshops
- Tickets. Each ticket admits one person. Bring the QR code from your order email; we scan it at the door, and each code works once.
- Ages. Events at venues that serve alcohol are 21+ unless the listing says otherwise; bring a photo ID. The venue's own rules apply while you're there.
- Timing. Please arrive on time. We can't hold the start for late arrivals or refund a missed session.
- Conduct. We may ask anyone who is disruptive, unsafe or intoxicated to leave, without a refund.
- Materials. Workshops use paints, glues, fabric, tools and other craft materials. Wear clothes you don't mind getting messy, follow the instructor's directions, and tell us before the event about any allergies or needs. You take part at your own risk, except where we've been careless.
- Photos. We may take photos and short videos at events for our website and social media. If you'd rather not appear, tell the instructor and we'll leave you out or blur you.
- Changes. We may change an event's instructor, project or time if needed. If we cancel or move it, see Refunds below.
Shipping, refunds and privacy
- Shipping. Shipping options, costs and estimated delivery times are shown at checkout. Delivery dates are estimates from the carrier, not guarantees. Risk in a piece passes to you on delivery; if it arrives damaged, our refund policy explains what we do.
- Refunds. All artwork sales are final, and event tickets can be refunded up to 5 business days before the event starts. The full details, including cancelled events and damaged deliveries, are in our refund and returns policy.
- Privacy. How we handle your information is set out in our privacy notice and the store's privacy policy.
Liability, law and contact
- Liability. If something goes wrong with an order or event, our total liability is limited to the amount you paid for it. We're not liable for losses we couldn't reasonably foresee. Nothing in these terms limits liability that the law doesn't allow us to limit, such as for injury caused by our negligence, or any rights you have as a consumer.
- Things outside our control. We're not responsible for delays or cancellations caused by events beyond our control, such as severe weather, venue closures or carrier delays; we'll refund you if we can't deliver or hold an event.
- Governing law. These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Dallas County, Texas, unless the law where you live gives you the right to use your local courts.
- Changes. We may update these terms; the version in place when you ordered applies to that order.
- Contact. Questions about these terms: legal@mcpgallery.art. Orders, tickets and refunds: caroline@mcpgallery.art.
